🔥Basically the SEC has been doing it's best to keep the Hinman documents confidential and keep them secret in the case being as they claim that Hinman wrote them in a personal matter while also looking to keep the very same speech secret by claiming that he received legal advice from the SEC to confirm the commission’s policies which quite simply makes things sound real dumb as it's hypocritical. Which they are.
🔥U.S. Magistrate Judge Sarah Netburn made sure to call them out of course on this as she said: “The hypocrisy in arguing to the Court, on the one hand, that the Speech is not relevant to the market’s understanding of how or whether the SEC will regulate cryptocurrency, and on the other hand, that Hinman sought and obtained legal advice from SEC counsel in drafting his Speech, suggests that the SEC is adopting its litigation positions to further its desired goal, and not out of a faithful allegiance to the law.”
🔥Basically she's saying that the motion is foolish and it's blatant that the SEC is just trying to say things and push their motions so that they can simply get a better position in their case against XRP now which has now made it blatant that they aren't really trying to be truthful and are trying tip toe around the truth and in the process basically interfering with the case and thus they we're denied the motion.
🔥Linked below is the full article but basically this could be a major tipping point in the case, especially being that the appeals judge will likely side with Netburn's decision should the SEC make an appeal. So keep an eye on that as it could not only impact XRP as we keep saying but Bitcoin and the rest of the market with that clarity!
